De bescherming van persoonsgegevens heeft de gemoederen in het eerste halfjaar van 2018 flink bezig gehouden. Hoewel de invoering van de Algemene Verordening Gegevensbescherming (''AVG'') in de kader veruit de meeste aandacht heeft gekregen, is ook de belangrijke deadline voor de implementatie van de nieuwe Europese Payment Service Directive 2 (''PSD2'') verlopen. De PSD2 bevat o.a. (juridisch spannende) regels over de nieuw te reguleren rekeninginformatiedienst op de Europese betaalmarkt. Aanbieders van deze dienst krijgen toegang tot de betaalrekening – met daarop gevoelige persoonsgegevens – van de gebruikers van de rekeninginformatiedienst indien deze hiervoor zijn uitdrukkelijke toestemming verleent.

In de bijdrage  van Edwin in de nieuwe uitgave van Jonge Meesters 'Nieuwe technologieën, nieuw privaatrecht' staat het wettelijk kader waarbinnen de hierboven genoemde rekeninginformatiedienst is gereguleerd centraal. Een belangrijke conclusie van de bijdrage is dat de Nederlandse wetgever gedurende de implementatie van de PSD2 onvoldoende aandacht heeft besteed aan de kwetsbaarheid van het toestemmingsvereiste binnen de rekeninginformatiedienst. Dat de Nederlandse wetgever in dit kader inderdaad te hard van stapel is gelopen volgt uit de huidige onvoltooide status van de implementatie van de PSD2. Gelukkig heeft minister van financiën recent aangegeven  dat de definitieve implementatie van de PSD2 niet lang meer op zich zal laten wachten


De bijdrage van Edwin is geschreven in de zomer van 2017 als afrondende scriptie van zijn succesvol afgeronde Master Privaatrecht aan de Erasmus Universiteit Rotterdam.
