Signalering: wetsvoorstel Wet Werk en Zekerheid aangenomen

Op 10 juni jl. heeft de Eerste Kamer het wetsvoorstel Wet Werk en Zekerheid (“WWZ”) aangenomen. De coalitiepartijen, CDA, D66, GroenLinks, ChristenUnie en SGP stemden voor het wetsvoorstel. In tegenstelling tot wat de regering voor ogen had, zullen de flex-maatregelen omtrent artikel 7:628 BW (onder meer nul-urencontracten), het concurrentiebeding, de proeftijd, de aanzegtermijn voor contracten voor bepaalde tijd en de wijzigingen in artikel 7:691 BW (het uitzendbeding) op 1 januari 2015 in plaats van per 1 juli 2014 in werking treden. Afwijkende afspraken ten aanzien van voornoemde onderwerpen in lopende cao’s blijven nog maximaal 1,5 jaar na die datum van toepassing (derhalve tot 1 juli 2016). De wijzigingen met betrekking tot de ketenregeling zijn eerder al uitgesteld en gaan in per 1 juli 2015. Hierop betrekking hebbende cao regelingen blijven echter nog maar maximaal 1 jaar geldig (derhalve ook tot 1 juli 2016). De wijzigingen omtrent het ontslagrecht zullen per 1 juli 2015 gaan gelden.
